*Prize drawing will be held on August 15, 2009. The deadline to purchase an entry is August 15, 2009; all entries and payments must be received by said date. Prizes will be award regardless of number of tickets sold. The odds of winning will vary based on the number of tickets sold.

* This entry represents a chance to win the opportunity to accept an offer of the stated prizes under terms and conditions set forth below and the "Winners Notification Agreement," the terms of which are hereby incorporated by reference within.

* Winners agree to accept prizes "as is" with absolutely no express or implied warranties given by Friends of Children's Hospital, Inc.

* Each winner will be sent a "Winner Notification Agreement" by certified, return receipt U.S. mail. Each winner will have seven (7) days from the date of their receipt of the Winner Notification Agreement to accept the gift by executing and returning the Winner Notification Agreement pursuant to the terms stated herein. Failure to execute and return the Winner Notification Agreement and accept the prize "as is," timely, and pursuant to the terms stated therein, will automatically result in forfeiture of the prize, with no substitution or alternative prize available to said original winner. The prize, at that point, will be offered to the next runner-up, and the prize will be awarded to such runner-up that accepts the prize pursuant to all terms and conditions.

* Except where specifically stated, prizes may not be substituted or exchanged.

* The $100 entry price is not deductible for federal or state income tax purposes. All sales are final and non-refundable. Friends of Children's Hospital, Inc., assumes no responsibility for lost, late, misdirected or non-delivered mail. All defective or incorrect entries are disqualified.

* Participants must be 18 years of age or older.

* Access to all prizes by winners will be restricted until fully and unconditionally accepted by the winner on terms and conditions set forth herein and in the Winner Notification Agreement and complete delivery is made to the winner. All prizes remain the sole property of Friends of Children's Hospital, Inc., until unconditionally accepted "as is" by the winners.

* Friends of Children's Hospital, Inc., reserves the right to use the names, pictures, video images and relevant quotes of all winners.

* Winners of each prize are subject to any and all Federal and State income taxes payable due to their acceptance of the prize. The winner of the Batson Hospital MiracleHome agrees that the written determination of a licensed appraiser obtained by Friends of Children's Hospital, Inc., will be used to determine the value of the home for income tax and all other purposes.

* The net proceeds from this Batson Hospital MiracleHome drawing and raffle will benefit Friends of Children's Hospital, Inc.

* The winner accepting the Batson Hospital MiracleHome will be subject to all applicable laws and regulations, including covenants and/or restrictions of the Providence Subdivision and laws, regulations and any applicable lease fees of the City of Madison and all other applicable governmental entities.

* Purchase of this entry constitutes full agreement by the purchaser with all terms and conditions set forth herein and in the Winner Notification Agreement.

Members of the Friends of Children's Hospital, Inc., board of directors and their immediate households are not eligible to participate.

* Winners need not be present at the drawing. Void where prohibited by law.

* The winner of the Batson MiracleHome will be responsible for all closing costs and any other expenses associated with the conveyance of the home.

*By participating in this raffle, you hereby release and agree to hold harmless Friends of Children's Hospital, Inc., Home Builders Association of Jackson, the University of Mississippi Medical Center and David Smith Builder, Inc. from any and all liability, claims, costs, expenses and obligations of any kind relating to your purchase of the entry and participation in this raffle, except for the obligation to convey the prizes in accordance with these rules and regulations, the Winner Notification Agreement and other terms and conditions.
